New Jersey speeding tickets by laser

Wednesday, August 12th, 2009

If you get a NJ speeding ticket by laser, there are a couple of legal requirements the officer must meet, and failute to meet them could be grounds to get your case dismissed.

The controlling legal case states in part:

3. Pre-operational checking procedures recommended by the manufacturer of the laser speed detector shall be shown to have been made in each case.

4. Speed measurements shall be admitted whether made in daylight or at night and within any temperature range likely to be found in New Jersey, even if made under conditions of light or moderately heavy rainfall, but speed measurements taken during heavy rain or while snow is falling shall not be admitted without the support of adequate expert testimony in the individual case.

5. Speed measurements made at any distance up to 1,000 feet shall be admitted, but measurements made at any distance in excess of 1,000 feet shall be admitted only with the support of adequate expert testimony in the individual case.

IF you were stopped in heavy snow, or outside of 1,000 feet, you may have grounds for dismissal.

About The Speeding Ticket Blog

Tuesday, August 11th, 2009

Speeding tickets are a controversial topic.

Some are well-deserved and punish reckless people who endanger the lives of others.

Some are issued to raise money – plain and simple. These speed traps are specifically set up to entrap motorists and collect fines.

Then there are so many debatable speeding tickets where a reasonable person can agree or disagree on whether the citation should have been issued.

In many cases, speeding tickets are flat-out wrong; issued to the wrong driver or in the wrong circumstance.

That’s why we have a court system, and why every American has the right to defend themselves and fight their speeding ticket.

This blog will attempt to report on speeding tickets, the art and science of fighting speeding tickets in court, and sometimes the funny and human side of this issue.
